These Terms & Conditions ("Terms") form a binding agreement between you ("you", "your", or "Customer") and FlutterGo.AI, operated by FLUTTERGO.AI (PRIVATE) LIMITED ("FlutterGo", "we", "us", or "our"), and govern your access to and use of the FlutterGo.AI websites, applications, APIs and services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
You are responsible for the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly at support@fluttergo.ai of any unauthorized use.
2. License to use the Service
Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes. We retain all rights, title and interest in and to the Service, including its software, models, design, and trademarks. You may not copy, resell, reverse engineer, or create derivative works of the Service except as permitted by law.
3. Acceptable use
You agree not to use the Service to:
- violate any law or the rights of others, including intellectual property, privacy or publicity rights;
- build, distribute or facilitate malware, spyware, phishing, fraud, or other malicious or deceptive software;
- generate or publish content that is unlawful, infringing, defamatory, harassing, hateful, sexually exploitative of minors, or otherwise harmful;
- attempt to gain unauthorized access to the Service, other accounts, or connected systems, or to disrupt or overload our infrastructure;
- circumvent usage limits, security controls, or rate limits, or use automated means to abuse the Service;
- misuse connected third-party accounts (such as GitHub, Google Play, Apple, or backend providers) in breach of their terms.
We may investigate and take action, including suspension or termination, for violations of this section.
4. Your content & intellectual property
Your content. You retain ownership of the prompts, designs, source code, assets and other materials you provide or that the Service generates for you ("Your Content"), subject to third-party rights and any open-source licenses that apply. To operate the Service, you grant us a worldwide, non-exclusive license to host, process, transmit, display and create derivative works of Your Content solely to provide, secure and improve the Service and as otherwise described in our Privacy Policy.
Generated projects. Subject to your compliance with these Terms and payment of applicable fees, you may use the Flutter projects, code and assets the Service generates for you for your own apps. You are responsible for reviewing, testing, securing and licensing what you ship.
Feedback. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
5. AI-generated output
The Service uses artificial intelligence to generate designs, code and other output. AI output may be inaccurate, incomplete, or insecure, and similar output may be generated for other users. You are solely responsible for reviewing, validating, testing and securing any output before relying on or publishing it, including ensuring it does not infringe third-party rights and meets applicable app-store and legal requirements. The Service is a tool that accelerates development; it is not a substitute for professional engineering or legal review.
6. Third-party services
The Service integrates with third-party platforms you choose to connect, including but not limited to GitHub, Google Play, Apple App Store / TestFlight, Supabase, Firebase, and payment processors. Your use of those platforms is governed by their own terms and policies, and you are responsible for complying with them and for any fees they charge (for example, Apple Developer Program fees, Google Play registration, or CI runner minutes). We are not responsible for third-party services and do not control their availability or behavior. When you connect an account, you authorize us to act on your behalf to the extent needed to perform the features you request (for example, creating a repository, pushing your code, setting deployment secrets, and triggering builds).
7. Plans, billing & renewals
Paid plans and their features and limits are described on our Pricing page. By subscribing, you authorize us and our payment processor to charge the applicable fees, plus any taxes, to your payment method on a recurring basis until you cancel. Fees are billed in advance for each billing period and, except as required by law or as stated in our Refund Policy, are non-refundable. You are responsible for keeping your payment information current; failed payments may result in suspension or downgrade.
You may cancel at any time from your account settings. Cancellation stops future renewals; your plan remains active until the end of the current paid period.
8. Trials & changes to plans or pricing
We may offer free or trial access with limits. We may change plans, features, limits, or pricing prospectively; we will provide reasonable notice of material changes, and price changes apply from your next billing period. Continued use after a change takes effect constitutes acceptance.
9. Availability & support
We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. We may perform maintenance, modify or discontinue features, and impose usage limits. Support is provided according to your plan.
10. Disclaimers
THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE OR ANY GENERATED OUTPUT WILL BE ACCURATE, SECURE, ERROR-FREE, OR THAT YOUR APP WILL BE APPROVED BY ANY APP STORE.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLUTTERGO AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
12. Indemnification
You will defend, indemnify and hold harmless FlutterGo and its officers, employees and agents from any claims, damages, liabilities, costs and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, your apps, or your breach of these Terms or applicable law.
13. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your license to use the Service ends. Sections intended to survive (including ownership, disclaimers, limitation of liability, indemnification, and governing law) survive termination.
14. Governing law & disputes
These Terms are governed by the laws of Pakistan, without regard to conflict-of-laws rules. You and FlutterGo agree to the exclusive jurisdiction of the courts located in Pakistan for any dispute, except where mandatory local consumer law provides otherwise. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
15. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date and, for material changes, take reasonable steps to notify you. Your continued use after the changes take effect constitutes acceptance.
